MoneyDiary grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial financial tracking and planning. You agree NOT to: (a) Use the Service for any illegal purpose or in violation of any local, state, national, or international law; (b) Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Service; (c) Use any automated system, including 'robots,' 'spiders,' or 'offline readers,' to access the Service; (d) Attempt to interfere with or compromise the system integrity or security; (e) Collect or harvest any personally identifiable information from the Service.
You retain full ownership of the data, files, and information that you submit or sync to MoneyDiary ('User Data'). By using the Service, you grant us a worldwide, royalty-free license to use, host, store, reproduce, modify, and create derivative works (such as aggregated usage statistics) of your User Data solely for the purpose of providing, maintaining, and improving the Service. We assert no ownership rights over your personal financial data.
The Service, including its original content, features, functionality, design, algorithms, and software, is and will remain the exclusive property of MoneyDiary Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MoneyDiary Inc.
Premium Subscriptions: Certain features require a paid subscription. Fees are billed in advance on a monthly or annual basis. Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Refunds: Payments are non-refundable except where required by law. Price Changes: We reserve the right to modify subscription fees with reasonable prior notice.
MoneyDiary may integrate with third-party providers (e.g., Plaid, Yodlee) to access your financial data. We do not control these third parties and are not responsible for their performance. You acknowledge that your use of such third-party services is governed by their respective terms and privacy policies. Account information displayed in MoneyDiary is retrieved from these third-party sources 'as-is' and may not reflect real-time bank data.
MONEYDIARY IS NOT A FINANCIAL ADVISOR, BANK, OR TAX ADVISOR. The Service is provided for informational and management purposes only. Insights, forecasts, and AI-generated suggestions are based on algorithmic analysis and should not be construed as professional financial advice. You are solely responsible for your financial decisions. MoneyDiary makes no representations or warranties regarding the accuracy, completeness, or suitability of the information for your specific circumstances.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MONEYDIARY INC., ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS.
You agree to defend, indemnify, and hold harmless MoneyDiary Inc. and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by discontinuing use of the Service or contacting support to delete your data.
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Residents of California have specific privacy rights under the CCPA.
Europe (EEA/UK/Switzerland): For users in the EEA, UK, and Switzerland: These terms are subject to the General Data Protection Regulation (GDPR) and applicable consumer protection laws. Nothing in these Terms limits your statutory rights as a consumer that cannot be waived by contract. You retain the right of withdrawal within 14 days of subscription. The Data Controller is MoneyDiary Inc. Disputes may be submitted via the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
Australia: For users in Australia: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.
Middle East (GCC): For users in the UAE, Saudi Arabia, and GCC countries: We process personal data in accordance with applicable laws, including the UAE Personal Data Protection Law (PDPL) and Saudi Arabia's Personal Data Protection Law (PDPL).
